The Case

A neighborhood. A rulebook. A $1 deal.

In October 2023, the Marvin Creek HOA board voted — without notifying homeowners — to grant the Village of Marvin a permanent public trail easement across private CCR-protected land for $1. The neighborhood's own rulebook contains an explicit prohibition: a notwithstanding clause. An absolute bar. The board never obtained the 80% homeowner vote required by N.C.G.S. § 47F-3-112.

An independent attorney called it void ab initio. A survey found 63% of homeowners opposed it. The HOA president wrote the Village Manager: "We continue to believe the easement should be returned." The trial court found the plaintiffs likely to succeed on appeal and issued a Rule 62 injunction halting the trail. The injunction is operative today.

In September 2025, the Union County Superior Court — the trial court — issued a Rule 62 injunction finding the Comiskeys "likely to succeed on appeal." Rule 62 is a trial court mechanism that preserves the status quo while an appeal is pending. Trail development is halted. No party has challenged it.

October 2023

HOA board votes without community notice to grant a perpetual $1 trail easement. No 80% vote. CCR notwithstanding clause violated. MDO § 1.8-3 violated. The easement is void from inception.

January–April 2024

Jan 1: Village employee Derek Durst trespasses and threatens violence in front of the Comiskey children. Jan 22: HOA meeting — "I can't wait to get blitzed out of my mind and stumble home." Apr 19: Independent attorney Roy Michaux confirms the board "far exceeded its authority."

October 2024

63% of homeowners oppose the easement. HOA President Damani formally requests its return. The Village says no. Eminent domain threats delivered through the HOA's own conflicted counsel. Board reverses.

October 28, 2025 — +5 Days

Five days after Chris Comiskey's protected speech, UCSO attorney Brandon Christian issues the Dirty Harry letter on official letterhead. The family is restricted to 911-only law enforcement — the only agency at their address. 149+ days operative. Case No. 3:26-cv-00159.

November–December 2025

Nov 4: Election Day threat. Lein resignation vacancy scheme. 70-30 electoral repudiation. Nov 2025: Anonymous employer complaint filed against Chris at RTX. Dec 2025: Mayor Pro Tem Vandenberg captured on hot mic to Village Attorney Spencer: "Keep me out of jail."

March 26, 2026 — Active Settlement

Village counsel Jake Stewart transmits MAR-2: easement return, Vandenberg carved out, $0 monetary. The Comiskeys' posture: accept and interpret on plain terms. The injunction is operative. No defendant has answered on the merits in any of the three active cases.
