In October 2023, the Marvin Creek HOA board voted — without notifying homeowners — to grant the Village of Marvin a permanent public trail easement across private CCR-protected land for $1. The neighborhood's own rulebook contains an explicit prohibition: a notwithstanding clause. An absolute bar. The board never obtained the 80% homeowner vote required by N.C.G.S. § 47F-3-112.
An independent attorney called it void ab initio. A survey found 63% of homeowners opposed it. The HOA president wrote the Village Manager: "We continue to believe the easement should be returned." The trial court found the plaintiffs likely to succeed on appeal and issued a Rule 62 injunction halting the trail. The injunction is operative today.
HOA board votes without community notice to grant a perpetual $1 trail easement. No 80% vote. CCR notwithstanding clause violated. MDO § 1.8-3 violated. The easement is void from inception.
